Welcome to BusOva. These Terms and Conditions ("Terms") govern your access to and use of the BusOva website, located at www.busova.com (the "Website"), and all related services, features, content, and applications offered by BusOva (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
"User", "you", or "your" refers to any individual who accesses or uses the Service, whether registered or unregistered.
"Member" refers to a User who has created a registered account on the Service.
"Content" refers to all text, data, images, photographs, graphics, information, and other materials uploaded, posted, or otherwise transmitted through the Service.
"User Content" refers to Content that Users submit, post, or transmit to the Service, including but not limited to bus data, photographs, specifications, fleet information, and comments.
"BusOva", "we", "us", or "our" refers to the operators and administrators of the BusOva platform.
To use the Service, you must be at least 13 years of age. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian to use the Service, and such parent or guardian must agree to be bound by these Terms on your behalf.
By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.
To access certain features of the Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You may not use a username that is offensive, vulgar, or infringes upon the rights of others.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other Users, or is otherwise objectionable. You may also request deletion of your account at any time by contacting us.
By submitting User Content to the Service, you grant BusOva a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating and promoting the Service.
You retain ownership of any intellectual property rights that you hold in User Content that you submit. However, by submitting User Content, you acknowledge that the purpose of BusOva is to create a collaborative, community-driven database, and that your contributions become part of this shared resource.
You represent and warrant that: (a) you own or have the necessary rights to submit the User Content; (b) the User Content does not infringe upon the intellectual property, privacy, or other rights of any third party; (c) the User Content is accurate to the best of your knowledge; and (d) the User Content does not violate any applicable law or regulation.
User Content must not contain material that is unlawful, defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable. We reserve the right to remove any User Content that violates these standards or these Terms, without prior notice.
You agree not to use the Service to:
The Service and its original content (excluding User Content), features, functionality, design, and underlying technology are and shall remain the exclusive property of BusOva and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.
The compilation, organisation, and arrangement of data within the Service constitutes a database in which BusOva holds rights. While individual factual data points (such as a bus's registration number) may not be copyrightable, the database as a whole is protected, and systematic extraction or reuse of substantial portions is prohibited without permission.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of personal information as described in the Privacy Policy.
The Service may contain links to third-party websites or services that are not owned or controlled by BusOva. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we are not liable for any damage or loss caused by your use of any third-party websites or services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BUSOVA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any Content available through the Service, including User Content. You acknowledge that any reliance on such Content is at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUSOVA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless BusOva and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.
Before initiating any formal dispute resolution proceedings, you agree to first contact us to attempt to resolve any dispute informally. We will endeavour to resolve disputes through good-faith negotiation.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
These Terms, together with the Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and BusOva regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of BusOva.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or failures of third-party services.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will notify Users by posting the updated Terms on the Service and updating the "Effective Date" at the top of this document. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
